Many States consider immigration detention a necessary tool for migration management, used to control borders and enforce migration policies. While States have the right to implement such measures, they must do so in compliance with international laws and standards. Detention is commonly used to identify individuals and confirm nationalities, prevent unauthorized entry, and facilitate deportation orders.
However, in many situations, the detention of migrants is poorly regulated and exists in a legal gray area. This often leaves migrants without adequate safeguards or remedies against abuse, and vulnerable to arbitrary or prolonged detention.
